Terms of Service

These Terms of Service ("Terms") govern your access to and use of Eminle's Emotional Reactor and the Echo chat experience (together, the "Service"), provided by Eminle ("we," "us," "our"). By using the Service, you agree to these Terms.

This is a template for a small, early-stage product and not a substitute for legal advice. Have a qualified lawyer review this before you rely on it commercially, particularly around liability limits, refunds, and any jurisdiction-specific consumer protection rules.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement.

2. The Service

Eminle provides an emotional-intelligence middleware layer ("Emotional Reactor") and a companion chat experience ("Echo") built on top of large language models. The Service is provided for companionship, reflection, and conversational support, and is not a medical device, therapy service, or crisis intervention service.

3. Accounts and tiers

The Service offers a free tier with usage limits and paid tiers with expanded features, described on our Pricing page. We may change pricing, features, or limits with reasonable notice.

4. Payment and subscriptions

Paid subscriptions are billed on a recurring basis (monthly, unless otherwise stated) through our payment processor.
You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period unless stated otherwise.

5. Acceptable use

You agree not to misuse the Service. See our Acceptable Use Policy for details on prohibited conduct.

6. Not a substitute for professional care

Echo and the Emotional Reactor are designed to feel emotionally present and responsive, but they are software, not a licensed therapist, doctor, or crisis counselor. If you are in crisis or experiencing a mental health emergency, please contact a local emergency service or crisis line rather than relying on the Service.

7. Intellectual property

The Emotional Reactor, its underlying systems, branding, and website content are the property of Eminle. You retain ownership of the messages you send, but grant us a license to process them as needed to provide the Service.

8. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free operation, and responses generated by the underlying language model may occasionally be inaccurate, inconsistent, or inappropriate despite our Safety Layer.

9. Limitation of liability

To the maximum extent permitted by law, Eminle is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

10. Termination

We may suspend or terminate access to the Service for violations of these Terms or our Acceptable Use Policy. You may stop using the Service at any time.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
